Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Silao PS case no. 39 of 2025, disclosing offences punishable under Section 126(2) and other allied sections of the B.N.S. Act and Sections 8/12 of POCSO Act. 3.

The prosecution story, as per the First Information report, is that the petitioner was continuously harassing the daughter of the informant, while she was going to school and in May, 2024, the petitioner eve-teased the informant's daughter. It is alleged that on 31.01.2025, when

No.21885 of 2025(2) dt.30-04-2025 2/3 the informant's daughter was returning from Silao market, at about 10.30 am, the petitioner suddenly reached at her and tried to snatch her dupatta and when she objected, he threatened her that if she would not talk to him, he would commit suicide. Thereafter, the informant's daughter raised alarm and went to her School and after returning from the School, she told about the incident to the informant. Then the informant along with her wife went to the house of the petitioner but the parents of the petitioner abused and assaulted them.

Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case. He further submits that the incident occurred on 31.01.2025 and F.I.R. has been lodged after delay of 14 days i.e. on 14.02.2025. He also submits that parties are closely related. The informant was the agent of Sahara India and he had opened several accounts of petitioner's side but on maturity, he did not return the money and due to that reason, quarrel took place and consequently, this false case has been lodged. 5.

The allegation against the petitioner is that he was continuously harassing the minor daughter of the informant, aged about 13 years and also tried to outrage her modesty, which comes under sexual assault. The victim girl has supported the prosecution story in her statement recorded under Sections 180 and 183 of B.N.S. Act.

Accordingly, I am not inclined to grant the petitioner privilege of anticipatory bail.

This application is, accordingly, dismissed.
