The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 448, 323, 504, 506/34 of the Indian Penal Code and 3(1)(x)(xi) of SC/ST (Prevention of Atrocities) Act. It is alleged that the accused persons entered into the house of the informant, abused the daughter-inlaw of the informant by calling caste name and made assault. It is specifically alleged against petitioner no. 1 that he pulled down the daughter-in-law of the informant, thereby she became half naked.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.39910 of 2015 (2) dt.05-10-2015 2/2 petitioners that admittedly the occurrence took place inside the house, hence, SC/ST Act is not attracted.
Since the investigation has already concluded and final form has been submitted, it is a case for consideration of prayer for regular bail, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Banka SC/ST P.S. Case No. 49 of 2014 pending in the court of learned Additional Chief Judicial Magistrate, Banka.
With the aforesaid observation, this application is disposed of.
