The petitioners are apprehending their arrest in connection with Karja P.S. Case No. 08 of 2014 for the offences punishable under Sections 323, 341, 342, 307, 504/34 of the Indian Penal Code.

Learned counsel for the petitioners submitted that petitioner No. 2 Deepak Kumar has already been arrested hence, he seeks permission to withdraw this application. So far as, petitioner no. 2 is concerned, this application as against the above mentioned is dismissed as withdrawn.

Learned counsel for the petitioners submits that there is ongoing dispute between the parties for which cases have been lodged by one party or the other.

Patna High Court Cr.Misc. No.46544 of 2014 (3) dt.03-08-2015 Learned counsel for the informant submits that the injury report clearly reveals that the injuries are grievous in nature. However, after perusal of the F.I.R. and after going through the injury report, which has been annexed as Annexure-3 the said injuries are not matching with the injuries as described in the injury report.

Considering the prosecution story and the submissions advanced by the petitioner, let the petitioner no. 1, Vikash Kumar in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Muzaffarpur in connection with Karja P.S. Case No. 08 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
