====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 01-02-2022 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State, through Video Conferencing.

This application, for grant of anticipatory bail, arises out of Jadopur Police Station Case No. 170 of 2020, disclosing offences under Sections 147, 341, 323, 324, 307 of the Indian Penal Code and later on Section 302 of the IPC was added.

Learned counsel for the petitioners has submitted that there is land dispute between both the parties. He has also submitted that the specific allegation of assault to the informant is on co-accused, Bullet Yadav, and not on the petitioner. He has also submitted that the informant died after nine days of the

Patna High Court CR. MISC. No.32511 of 2021(2) dt.01-02-2022 2/2 occurrence and the cause of death is not the assault rather it is chronic liver disease, as has been mentioned in post-mortem report.

Learned Addl. P.P. has opposed and the prayer for bail.

Consideration the fact that there is no specific allegations against the petitioners to assault the informant rather the allegations against them is general and omnibus and also considering the fact that it has been mentioned in the order of Additional Sessions Judge, Gopalganj that as per pot-mortem report, the cause of death is chronic liver disease, as such, let the petitioners, named above, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Devendra Prasad, Judicial Magistrate, Ist Class, Gopalganj, in connection with Jadopur Police Station Case No. 170 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
