JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-07-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 7 of the Essential Commodity Act.

As per the prosecution case, 18 bags rice kept on a Pick Up vehicle was seized by the police and its driver was apprehended who disclosed that the said rice was of the petitioner.

Learned counsel appearing for the petitioner submits that the petitioner's name has figured during course of investigation in confessional statement of co-accused. Petitioner is not owner of seized article. He has got no concerned with alleged recovery. Petitioner is not the PDS dealer. Petitioner claims clean antecedent.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender

Patna High Court CR. MISC. No.24212 of 2023(3) dt.05-07-2023 2/2 within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate Supaul in Triveniganj Police Station Case No. 137 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
