Having regard to the statement made in the show-cause reply that there is only one single post for Graduate Trained Teacher in the school and as per the government policy that has to go to B.A. Trained Teacher, this Court would not find that the petitioner, having his claim of B.Sc. Trained Teacher, would have been accommodated on the solitary post.

Thus, this Court is of the view that the direction given by this Court in the connected writ application has been complied

Patna High Court MJC No.2787 of 2014 (3) dt.03-08-2015 in letter and spirit.

Nothing said in this order, however, shall stand in the way of the petitioner to assail the order that has been passed by the authority.

With the aforementioned observation and liberty, this application is disposed of.

The personal appearance of Mr. Yogesh Chandra Singh, District Education Officer, Nalanda and Md. Shafi Ahmad, District Programme Officer (Establishment), Nlaanda is dispensed with.
