Heard learned counsel for the parties.

This application for regular bail arises out of Khanpur P.S. Case No. 103 of 2020, disclosing offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The petitioner is in custody since 15.07.2020. His prayer for regular bail was earlier rejected by this Court by an order dated 07.12.2020 passed in Cr. Misc. No. 32269 of 2020 with an observation that if there was no substantial progress in the trial, the petitioner may renew his prayer for regular bail after six months.

Patna High Court CR. MISC. No.32469 of 2021(2) dt.04-08-2021 2/2 Learned counsel for the petitioner has submitted that the petitioner has no criminal antecedent and there is no progress at the trial.

It transpires from the First Information Report that on the allegation of recovery of 237.300 liters of Indian made foreign liquor from the petitioner's house, the petitioner was apprehended.

Considering the petitioner's incarceration and the fact that the petitioner has no criminal antecedent, this application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Samastipur in Khanpur P.S.
