Petitioner seeks bail in Jaynagar P.S. Case No. 589 of 2018 instituted for the offence under Section(s) 272, 273/34 Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioner submits that petitioner has clean antecedents. He was merely sitting in the pick-up van. He is not owner of the said van.

It is alleged that police has intercepted the pick-up van on which two persons were found sitting. The police recovered total 1080 litres of foreign liquor from the said van. It has further been submitted that the owner of the said van has already been granted bail by co-ordiante Bench of

Patna High Court Cr.Misc. No.786 of 2019(2) dt.16-01-2019 2/2 this Court vide order dated 11.01.2019 passed in Cr. Misc. No. 79408 of 2018.

Petitioner is said to be in custody since 16.10.2018 having clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge IIcum-Special Judge, Excise Act, Madhubani, in connection with Jaynagar P.S. Case No. 589 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
