The petitioner seeks regular bail in connection with Shambhuganj P.S. Case No. 141 of 2019 instituted for the offences under Sections 304 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 04.01.2021, charge-sheet has been submitted in the case and is a person with clean antecedent. Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that the informant alleges that her daughter was married to Amarjeet Singh @ Munna on 28.02.2018 and after marriage demand for dowry started and the family members of the husband of the deceased started demanding Rs. 1,50,000/-. It is further alleged that on 29.06.2019, the informant was

Patna High Court CR. MISC. No.34332 of 2021(2) dt.01-12-2021 2/2 informed that his daughter died due to drowning. Accordingly, the informant reached the matrimonial home of the deceased where he found his daughter dead.

The learned counsel for the petitioner submits that petitioner is the cousin brother of the father-in-law of the deceased and as such does not have any concern with the family life of his nephew and brother and the petitioner is completely separate in mess and property.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 04.01.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Shambhuganj P.S. Case No. 141 of 2019 subject to the condition as laid down under Section 437 (3) Cr.P.C.
