JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-03-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Ranitalab P.S. Case No.154 of 2019 for offences under Sections 147, 148, 149, 341, 323, 307 and 379 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioners submits that the petitioners have no criminal antecedent. The allegation against the petitioners and others is that they assaulted the informant side in connection with dispute for loading sand from Ghat of the informant. Learned counsel for

No.23336 of 2020(3) dt.22-03-2021 2/2 the petitioners with reference to Annexure-3 would submit that the parties have settled the dispute and they have submitted a joint compromise petition. It is submitted that the offence is non-bailable but Annexure-3 is relevant for the purpose of bail. Considering the compromise petition (Annexure-3) for the purpose of bail, this Court is inclined to grant the privilege of anticipatory bail to the petitioners. Let petitioners, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of Mr. P.K. Malviya, Judicial Magistrate, 1st Class, Danapur, Patna in connection with Ranitalab P.S. Case No. 154 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
