The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 341, 323, 385, 337, 338, 324, 307, 354, 379 and 504 of the Indian Penal Code.
A civil suit is going on between the parties. In the aforesaid background, allegation is of commission of assault. The petitioner allegedly committed theft of golden chain and a Titan watch at the time of occurrence. Submission is that allegation is ornamental one. Petitioner has got no criminal antecedent. Land dispute is the reason behind false implication.
Let the petitioner, above named, in the event of his
Patna High Court Cr.Misc. No.414 of 2019(2) dt.28-01-2019 2/2 arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Khanpur Police Station Case No.52 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
