JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 324, 307, 386/34 of the Indian Penal Code.
Petitioner is said to have demanded extortion money of rupees one lac from informant and when the demand was not fulfilled, he along with his entire family members went to the house of the informant and assaulted the informant and his other family members. There is specific allegation against the petitioner that he assaulted the informant with butt of pistol causing injury on his head. Patna High Court Cr.Misc. No.289 of 2019(2) dt.17-01-2019 2/2 counter case between the parties and both parties making serious allegations against each others. However, the impugned order also reveals that at the time of hearing of bail petition of the petitioner, the injury reports of two injured i.e., Prince Kumar and Rajesh Ranjan were produced by the prosecution before the learned Sessions Judge. The aforesaid fact goes to show that the informant had not sustained any injury. Moreover, the petitioner is in jail custody since 27.09.2018. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai (Mufassil) P.S. Case No. 169 of 2018.
