Let the defect(s), if any, be removed within a period of four weeks from today.

This application is filed for grant of regular bail in connection with Runni Saidpur P.S. Case No. 75/2023 registered under section, 420/468/120(B)/341 of the Indian Penal Code 30(a)/32/36/41(i) and 41(i)(ii) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioners submits that there

Patna High Court CR. MISC. No.23843 of 2023(2) dt.17-05-2023 2/3 is recovery of 3918/615 litres of illicit liquor. Petitioners has offered to deposit Rs. 50,000/- each (total of Rs. 1 Lakh) in Ram Krishna Mission Sevashrama, Swani Vivekanand Path, Bela, Muzaffarpur, Bihar-842002. They have no antecedent and also they are in custody since 10.02.2023.

Learned A.P.P. has vehemently opposed the prayer for bail.

Petitioners have granted regular bail. Let the petitioners, above named, be released on bail after framing of charge and on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction learned Exclusive Special Excise Judge-1, Sitamarhi in connection with Runni Saidpur P.S. Case No. 75/2023. Petitioner's bail bond shall be accepted only after they produce the receipt of Rs. 50,000/- each (total of Rs. 1 Lakh) issued by Ram Krishna Mission Sevashrama, Swani Vivekanand Path, Bela, Muzaffarpur, Bihar-842002 and after verification of the genuineness of the receipt. The Court below is directed to verify the recent address of the petitioner before releasing him and one of the bailor should be blood relative of the petitioner and he shall be released after framing of charge.
