The petitioners apprehend their arrest in connection with Bangoan P.S. Case No. 27 of 2015 registered for the offences punishable under Sections 323, 324, 341, 307, 34 of the Indian Penal Code.

Leaned counsel for the petitioners submits that admittedly, the altercation took place on account of demand and refusal of Tobaco (Khaini) while petitioners were passing through the field of informant. It is further submitted that there is no motive whatsoever of the petitioners to attack the informant. Leaned counsel for the State on perusal of the case diary submits that there is no cogent evidence to support the

Considering the aforesaid submissions and also the fact that petitioners have no criminal antecedent, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Bangoan P.S. Case No. 27 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C..
