Petitioner seeks regular bail in connection with Singhwara P.S. Case No. 02 of 2020 dated 6.1.2020 registered for the offence punishable under Section 34-A of the Indian Penal Code.

This is second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier on two occasions the bail applications of the petitioner were rejected by this Court vide orders dated 9.7.2021 and 22.12.2021 passed in Cr. Misc. 40293 of 2020 and 47946 of 2021 respectively. This Court vide order dated 19.04.2023 had called for a report from the trial court regarding stage of trial and in

Patna High Court CR. MISC. No.24750 of 2023(3) dt.17-05-2023 2/2 pursuance thereof, the report of learned 1st Additional Sessions Judge, Darbhanga, dated 26.4.2023, is on record and from perusal of the same, it appears that out of 12 witnesses, seven have been examined and I.O. being the PW No. 8 has been examined partly. Four witnesses are yet to be examined. The trial court has given the estimated time for completion of trial within six months.

Taking into consideration the nature of allegation and the material collected during course of investigation, I am not inclined to grant bail to the petitioner at this stage. Accordingly, the prayer for bail of the petitioner stands rejected.

However, the petitioner may renew his prayer for bail after six months if the trial does not conclude. (Anil Kumar Sinha, J) S.Ali/- U T
