2. The petitioner apprehends his arrest in connection with Barh P.S. Case No. 321 of 2022 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, 520 litre of illicit liquor was recovered from the spot. Petitioner managed to flee away from the spot. The apprehended co-accused persons have disclosed the name of the petitioner.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to previous enmity. Further submission is that the name of the petitioner has been dragged in this case merely on the statement of co-accused persons.

5. Learned A.P.P. appearing on behalf of the petitioner opposes the prayer for bail by contending that petitioner has two criminal antecedent of similar nature. Hence, he does not deserve the privilege of anticipatory bail.

6. Having considered the facts and circumstances of the case and the criminal antecedent of the petitioner, this Court is not inclined to grant anticipatory bail. His prayer, is accordingly, rejected.
