====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 07-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Nadi P.S. Case No. 35 of 2018, instituted for the offence under Sections 420, 467, 468/34 of Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Amendment Act pending in the court of Special Judge, Excise, Bettiah, West Champaran. Counsel for the petitioner submits that petitioner is in custody since 7.9.2018.

It is alleged in the written report that on secret information that illicit foreign liquor is being loaded in Bolero vehicle and the same is being unloaded in a boat on the bank of river Gandak, the informant along with police personnel

Patna High Court Cr.Misc. No.1067 of 2019(3) dt.07-02-2019 2/2 reached the place of occurrence and saw 14-15 persons unloading the illicit foreign liquor on a Boat. Out of them, one person was apprehended by the police and rest managed to run away. On search 120 cartons of foreign liquor from Bolero Pickup van and 80 cartons of foreign liquor from boat, total 1728 liters were recovered.

There is recovery of huge quantity of foreign liquor from the Bolero pick-up van and Boat. The petitioner was arrested on spot. Therefore, this Court is not inclined to grant bail to the petitioner at this stage.

Prayer of the petitioner for grant of bail stands rejected.

Petitioner is given liberty to renew his prayer for bail after completion of six months in custody if no substantive progress is made in the trial.
