The petitioner is apprehending his arrest in connection with Nawa Nagar (Sonevarsa) P.S.Case no.198 of 2018 registered for offences punishable under Sections 30(a) of Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is about recovery of 852 ltrs. of liquor from the truck and the police has suspected hands of the petitioner who has been named in the FIR. Apart from that he is accused in four other cases out of which three cases are under the Excise Act.

Submission of the learned counsel for the petitioner is that except suspicion there is nothing against the petitioner and he has been falsely implicated in this case.

No.79136 of 2018(3) dt.01-03-2019 2/2 Having heard both sides and in view of allegation and criminal antecedent, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court. With the aforesaid observation, this application is dismissed.
