JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-07-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Naurangia Police Station Case No. 14 of 2017, disclosing offences under Sections 120B/409/467/468/34 of the Indian Penal Code.
Learned Counsel appearing on behalf of the petitioner has drawn my attention to an order of this Court, dated 18.05.2016, passed in Cr.W.J.C. No. 98 of 2016, to submit that in similar circumstance, the Court has quashed the criminal prosecution.
The allegation against the petitioner is that he had secured appointment nearly 29 years ago on the basis

No.25377 of 2017 (2) dt.06-07-2017 2/3 of forged caste certificate and after his superannuation in 2016, the present First Information Report has been lodged with the said allegation of having supplied forged document to secure appointment. Learned Counsel for the petitioner has submitted that no departmental proceeding was ever initiated against him. He has also submitted that the petitioner will not flee away from the course of investigation or trial.
Considering the above submission, this application is allowed.
Let the petitioner, Shashi Bhushan Ravi, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate II, Bagaha, West Champaran, in connection with Naurangia Police Station Case No. 14 of 2017, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be
