JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-03-2019 The petitioner apprehends his arrest in connection with Barhara P.S.Case No. 197 of 2016 registered under Sections 307, 323, 324, 341, 379, 504 and 506/34 of the Indian penal Code.
Allegation as per FIR is that a dispute arose with respect to election of Mukhia and there is allegation against this petitioner is of assault by rod on the head of informant causing injury and another accused has assaulted by knife causing injury on the right thumb.
Submission of learned counsel for the petitioner is that there is case and counter case in between the parties and petitioner has also received injury in that case and FIR itself shows that dispute is with respect to election of Mukhiya. Heard learned APP also.

No.842 of 2019(4) dt.25-03-2019 2/2 Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhojpur at Ara in connection with Barhara P.S. Case No. 197 of 2016; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
