2. This application has been filed for modification of order dated 16.01.2026 passed in Cr. Misc. No. 69549 of 2024 by this Court.

Learned counsel for the petitioner submits that due to some unavoidable reasons, the petitioner could not comply with the Memorandum of Agreement dated 12.02.2025 and out of total amount of Rs. 1,09,50,000/-, petitioner has already paid Rs. 63,40,000/- to the informant/Opposite Party No. 2 and seeks further four months' time to pay the rest outstanding amount i.e.

Patna High Court CR. MISC. No.24906 of 2026(3) dt.01-05-2026 2/2 Rs. 46,10,000/-.

In view of reasons assigned in the petition, further eight weeks' time from today is granted to the petitioner, above named, to surrender and furnish fresh bail-bond before the concerned Court where the case is pending, subject to deposit of Rs. 15,000/- (Rupees Fifteen Thousand) to the concerned District Legal Services Authority and to furnish its receipt with the bail-bond. Further, the petitioner shall abide by all the terms and conditions, as mentioned in the Memorandum of Agreement dated 12.02.2025 and pay the total outstanding amount i.e. Rs. 46,10,000/- (Forty-six lakhs ten thousand rupees) to the informant/Opposite Party No. 2 within a period of four months from the date of furnishing fresh bail bonds, failing which, the learned Court concerned shall be at liberty to cancel the bail bonds.

5. Accordingly, order dated 16.01.2026 passed in Cr. Misc. No. 69549 of 2024 is modified to the above extent and this modification petition is allowed.
