This application, for grant of anticipatory bail, arises out of Bihpur Police Station Case No. 14 of 2017, disclosing offences under Sections 365/370/34 of the Indian Penal Code.
It is alleged in the First Information Report that on petitioners' assurance, the victim had gone with them for doing some job on payment of Rs. 2,000/- per month, who is traceless. On the basis of suspicion that the petitioners are responsible for his disappearance, the First
Patna High Court Cr.Misc. No.25596 of 2017 (2) dt.10-07-2017 2/2 Information Report has been registered.
Learned Counsel for the petitioners has rightly submitted that over and above suspicion, there is nothing to implead these petitioners.
This application is, accordingly, allowed.
Let the petitioners, namely, Baby Devi and Lila Devi, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate I, Naugachia, Bhagalpur, in connection with Bihpur Police Station Case No. 14 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
