JUSTICE BIRENDRA KUMAR ORAL ORDER 07-07-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 447, 341, 323, 504, 324 and 307/34 of the Indian Penal Code. Petitioner is the full-brother of the informant. Allegation is of commission of assault with intent to commit murder.
Submission is that the parties have entered into a written compromise though the allegation is of commission of assault at the head.
However, considering the fact that the victim and the petitioner have entered into a compromise and the nature of

No.24794 of 2017 (3) dt.07-07-2017 2/2 relationship between the parties, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Darbhanga/successor Court in connection with Keoti Police Station Case No. 32 of 2017 to avoid further score in the relationship between the two full-brothers, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
