Petitioners seek bail in Excise Case No. 829 of 2017 for the offence registered under Section 30(a) of the Excise Prohibition Act, 2016.
The accusation is that on receiving the secret information about keeping Java Mahua near Tati river in village Murarpur by both petitioners for preparing liquor, the informant S.I. Shivendra Kumar along with other police officials reached there and recovered 8 liter country made liquor kept in white container and 780 K.G. Gava Gur kept in 52 dalda container each containing 15 K.G.
Submissions is that both the petitioner have been
Patna High Court CR. MISC. No.23335 of 2019(2) dt.11-04-2019 2/2 made accused in several cases as mentioned in para 3 of the petition. Further submission is that both the petitioners have falsely been implicated in this case. Both the petitioners are in custody since 25.02.2019.
Having regard to the facts and circumstances of the case, let both the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of 2nd Additional District & Sessions Judge, Sheikhpura, in Excise Case No. 829 of 2017 subject to the condition that one of the sureties must be relative of the petitioners.
