In this case, the petitioners are apprehending their arrest in connection with Madhuban P.S. Case No. 55 of 2017 (G.R. Case No. 1276 of 2017) registered for offence under Sections 272, 273, 353, 420 of the Indian Penal Code and Section 30, 36, 37, 38 and 45 of the Bihar Prohibition and Excise Act. As per allegation, the police have received information, the police surrounded the Baithaka of Santosh Kumar Singh where he was found in intoxicated condition and found one bottle Royal Stage Wine of 750 Ml in which there was about 200 Ml wine left. No.24758 of 2017 (2) dt.10-07-2017 the petitioners tried to obstruct the arrest of the aforesaid accused person led to the present case and, thus, this case has no connection with the Bihar Prohibition and Excise Act. Looking to the entire facts and circumstances of the case, let the petitioners, namely, Vinita Kumari alias Vinita Kunwar and Kumkum Devi, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, IVth, East Champaran at Motihari in connection with Madhuban P.S. Case No. 55 of 2017 (G.R. Case No. 1276 of 2017), subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Shivaji Pandey, J) Rishi/- U T
