This application for anticipatory bail, arises out of Sikandra Police Station Case No. 164 of 2018, disclosing offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code.

There is allegation against the petitioner of having assaulted the informant's brother with the reverse side of axe on his neck.

Learned counsel, appearing on behalf of the petitioner, has submitted that the occurrence is said to have taken place on 15.07.2018, whereas the First Information Report has been registered on 17.07.2018. He further contends that for the same occurrence an FIR was lodged by son of the petitioner,

Patna High Court CR. MISC. No. 21426 of 2019(2) dt.05-04-2019 2/2 who has also been made co-accused, on 15.07.2018, which was registered as Sikandra P.S. Case No. 160 of 2018. It has been asserted that the petitioner has no criminal antecedent. Considering the genesis of occurrence, this application is allowed.

Let the petitioner, above-named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each to the satisfaction of the Sri M.K. Pandey, Judicial Magistrate-Ist, Jamui, in connection with Sikandra Police Station Case No. 164 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
