The petitioner apprehends his arrest in Complaint Case No. 1086 (c) of 2013 registered for the offences punishable under Sections 323, 498A, 504/34 and other Sections of the Indian Penal Code.
On the last occasion when the parties were present in Chambers it was directed that the opposite party no. 2 should bring on record the orders passed by the Hon'ble Apex Court and also the report of the Mediation and the current status of the same. Today, an affidavit has been filed annexing the documents from which it is evident that the mediation proceeding before the Hon'ble Apex Court has failed and the transfer petition
Patna High Court Cr.Misc. No.50673 of 2014 (4) dt.06-08-2015 which was filed by the Opposite party has been allowed and sent back to the Family Court, Saharsa, Bihar for further action. Learned counsel for the petitioner submits that he is ready and willing to keep the lady, in question, as on date and also undertakes that she will not be prejudiced in any manner and will render all possible cooperation for leading a happy conjugal life. Learned counsel for the Opposite party no. 2 submits that she is also ready and willing to live with him.
Considering the aforesaid submissions, it is evident that the petitioner has extended and undertakes that there shall be no recurrence of untoward incident at his hand and in view of the earlier interim order passed by this Court and consistent stand adopted by the petitioner, let the petitioner, in the event of their arrest or surrender before the court below within a period of two weeks from the date of receipt/production of a copy of this order, is/are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Saharsa in connection with Complaint Case No. 1086 (c) of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C..
