ANJANA MISHRA ORAL ORDER 05-08-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Chand P.S. Case No. 46 of 2016 for the offences registered under Sections 304(B)/34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioner no. 1 is the Bhaisur whereas petitioner no. 2 is the wife of the deceased. It is further submitted that petitioners have no role to play with the aforesaid offence. It is further submitted that husband of the deceased has already been taken into custody.

Considering the nature of allegation made against the petitioners and also the fact that husband of the deceased having developed illicit relation with the daughter of the neighbour, let

Patna High Court Cr.Misc. No.27637 of 2016 (2) dt.05-08-2016 the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Chand P.S. Case No. 46 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
