2. The petitioner seeks bail, who is in custody since 15.06.2022 in connection with Bhagwanput Hat P.S.Case No.226 of 2021, S.T. No.579 of 2022, F.I.R. dated 15.10.2021 registered for the offence punishable under Sections 304(B)/201/120(B)/34 of the Indian Penal Code and Section 3/4 of D.P.Act.

3. Allegation against the petitioner is that he alongwith other co-accused persons have in furtherance of their common intention committed the dowry death of the daughter of the informant.

4. Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. He has falsely

The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR. The petitioner has falsely been implicated on the ground that the petitioner is husband of the deceased.

5. Learned APP for the State, on the other hand, has opposed the prayer for bail of the petitioner and submits that there is sufficient material has come during investigation against the petitioner to suggest the involvement of the petitioner in the present occurrence and a number of independent witnesses have supported the allegation as alleged in the FIR and it has also come during investigation that after committing the murder, the petitioner and his family members have disposed of the dead body of the deceased.

6. Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with Bhagwanput Hat P.S.Case No.226 of 2021, S.T. No.579 of 2022 pending in the court of learned A.c.J.M.-IX, Siwan.

7. Prayer is refused.
