JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-04-2019 The petitioner apprehends his arrest in connection with Murar P.S.Case No. 02 of 2019 registered under Sections 25(1b)a/26 of the Arms Act. Allegation as per FIR is that the police intercepted a motorcycle and one person after throwing pistol succeeded in fleeing away and another was apprehended who disclosed the name of petitioner as person who fled away. It further appears that petitioner is accused in six more cases. Submission of learned counsel for the petitioner is that except disclosure of name by the co-accused, there is nothing against the petitioner and so far other cases are concerned, in four cases he is on bail and in two cases he has been acquitted. Heard learned APP also.

Having heard both sides and in view of the nature of allegation and criminal antecedent, I am not inclined to grant

Patna High Court CR. MISC. No. 22274 of 2019(2) dt.08-04-2019 2/2 privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
