The petitioner seeks bail in connection with Madhepura P.S. Case No. 406 of 2019 dated 06.05.2019 instituted for offence under Sections 395 and 397 of the Indian Penal Code.

It appears from the First Information Report that the informant was robbed of his motorcycle by some miscreants. One of the accused persons was arrested, who named many other persons including petitioner. Thus, for all

Patna High Court CR. MISC. No.25993 of 2020(2) dt.13-10-2020 2/2 practical purposes, the petitioner though has been named but only on the confession of an arrested accused person. He has not been put to Test Identification Parade and nothing incriminating has been recovered from his possession. He is in custody since 06.03.2020.

Regard being had to the afore-stated facts and also taking into account the clean antecedent of the petitioner, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, Pupri, Sitamarhi, in connection with Madhepura P.S. Case No. 406 of 2019.
