2. The petitioner seeks regular bail in connection with Majhauliya P. S. Case No. 644 of 2024, dated 29-10-2024, registered for offences punishable under Sections 103(1) and 61(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.
3. As per the First Information Report (for brevity, 'FIR'), some unknown person is alleged to have committed the murder of the younger son of the informant, namely Abhinandan Kumar, who was doing the job of mason at Bangalore and came to his village on the eve of 'Chhath' Puja'.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the
Patna High Court CR. MISC. No.22306 of 2025(3) dt.03-09-2025 2/3 present case. It is further submitted that the FIR was lodged against unknown accused persons, and the petitioner has been made an accused merely on the basis of the confessional statement of co-accused Sukesh Patel. It is also submitted that not incriminating article has been recovered either from the conscious possession of the petitioner or from her house. One mobile phone of Vivo company was recovered from the house of the grandfather of co-accused Sukesh Patel, namely Raghunath Patel. The petitioner has no concern whatsoever with said Sukesh Patel. Further submission is that the petitioner is the wife of the elder full brother of the deceased. She has three children; the youngest, a male child aged about six months, is presently with her in jail. The other two children, aged about three years and two years, respectively, are at home with no one to look after them. Lastly, it is submitted that the petitioner has been in judicial custody since 30.10.2024 and has no criminal antecedents.
5. Learned Additional Public Prosecutor for the State has opposed the prayer.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of
Patna High Court CR. MISC. No.22306 of 2025(3) dt.03-09-2025 3/3 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Bettiah, West Champaran/Successor Court in connection with Majhauliya P.S. Case No. 644 of 2024.
7. The application stands allowed.
