24.08.2020 Heard Mr. Sanjeev Kumar Singh, learned counsel for the petitioners and Mr. Amit Kumar Rakesh, learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Kadwa P. S. Case No. 298 of 2019 dated 25.12.2019, instituted for the offences under Sections 30(a) of Bihar Prohibition and Excise Act, 2016.

The petitioner nos. 1 and 2 have been arrested during the pendency of this petition.

The learned counsel for the petitioners seeks permission to withdraw their petition.

Permission is accorded.

So far as the petitioner no. 3 is concerned, I am not inclined to grant bail to him.

Prayer for anticipatory bail with respect to Petitioner No. 3 is rejected.

In case the Petitioner No. 3 surrenders before the court below and seeks bail, the same shall be considered on its own merits, without being prejudiced by the fact that the present petition has not been entertained by this Court.
