Petitioners are apprehending their arrest in connection with a case registered for the offences under Section 307 and other allied Sections of the Penal Code and Sections 3(i)(x)(2)(v) of the Scheduled Castes/ Scheduled Tribes (Prevention of Atrocities) Act. They are named in the First Information Report and are not only closely related but also members of the same family.
It is submitted on behalf of the petitioners that there has been brick-batting from both sides, but the injuries
Patna High Court Cr.Misc. No.40212 of 2015 (2) dt.05-10-2015 2/2 caused on the members of the prosecution party of the present case is simple in nature.
Let petitioners, named above, surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order in the court below and apply for regular bail, which should be considered in the light of the nature of injuries suffered by the members of the prosecution party. In case, the injuries on the person of the prosecution party are found simple, the petitioners be admitted to the privilege of bail on furnishing bail bonds, amount of sureties whereof shall be fixed by the court below, otherwise the court below shall be at liberty to pass appropriate order in accordance with law.
