JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 01-07-2017 Heard learned counsel for the petitioner; learned A.P.P. for the State and learned counsel for the informant, who has suo motu appeared.
2. The petitioner apprehends arrest in connection with Sahajitpur P.S. Case No. 102 of 2016 dated 08.12.2016 instituted under Sections 341/323/324/307/504/34 of the Indian Penal Code.
3. The allegation against the petitioner is of stabbing the informant. Against the petitioner, the specific allegation is of stabbing in the abdomen.

Learned counsel for the petitioner submitted that though the occurrence is said to have occurred in a marriage ceremony on 25.11.2016 at 9:30 p.m. but the fardbeyan has been recorded on 03.12.2016 at 6:10 p.m. and thereafter, F.I.R. has been instituted on 08.12.2016. It was submitted that for such delay there is no explanation. Learned counsel further submitted that the petitioner is a student and has been falsely implicated due to village rivalry.

Learned A.P.P. and learned counsel for the informant submitted that upon such assault, he had become unconscious and the local hospitals were not ready to admit the petitioner due to which he was admitted to a prestigious hospital at Patna where he remained in the I.C.U. and was not allowed to meet anybody and only when he became fit, his statement has been recorded by the Sub Inspector of Shastri Nagar Police Station at Patna on 03.12.2016 and the same was forwarded to the Sahajitpur Police Station in the district of Saran. It was further submitted that from the injury report itself it is clear that there were wounds on the chest and abdomen which were grievous.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, the Court is not inclined to enlarge the petitioner on anticipatory bail.
7. The application, accordingly, stands dismissed.
