2. The petitioners have prayed for regular bail in a case registered for the offence punishable under Sections 126(2), 115(2), 117(2), 109, 351(2), 351(3), 352 and 3(5) of the B.N.S.
3. The case of the prosecution, in short, is that the petitioners along with other being armed with weapon arrived at the door of the informant. They started assaulting with intention to kill. Brijbihari Bin assaulted with farsa on the head of the informant's husband. It is alleged that petitioner no. 2 Bhuar Bind assaulted Indrajit Bin and petitioner no.1 Angrahit Bind assaulted the informant.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.25815 of 2026(2) dt.18-04-2026 2/2 petitioners has submitted that petitioners are innocent and have committed no offence. They have been falsely implicated in this case. Learned counsel for the petitioners has submitted that injury of both the persons whom the petitioners have assaulted is simple which is apparent from the order of the learned trial Court. It has further been submitted that similarly situated co-accused persons have been granted bail by learned Co-ordinate Bench of this Court vide Cr. Misc. No. 24523 of 2026. Petitioners are having no criminal antecedent and they are languishing in judicial custody since 16.01.2026 and 19.01.2026.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Buxar Muffasil P.S. Case No. 05 of 2026.
