JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Nine bags of rice, each containing 50 kilograms, of government supplied, are said to have been recovered from a tempo on which petitioner was also sitting. Petitioner happens to be P.D.S dealer and for the aforesaid offence, he is languishing in jail custody since 06.04.2016 whereas other two co-accused have already been granted privilege of bail.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Gaya in connection with Parriya P.S.case No. 46 of 2016.
