The petitioner seeks anticipatory bail in Mahua P.S. Case No.59 of 2017 instituted for the offences under Section 414 of the Indian Penal Code and Sections 30(A), 32 (ii) 38(ii) and 41(i) of the Bihar Esxcise Act, 2016.
The police has intercepted the truck from where huge quantity of foreign liquor was recovered. The police has apprehended Raushan Kumar Rai (driver) who has disclosed the name of the petitioner who is owner of the liquor. In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly the prayer for bail is rejected. However, if the petitioner surrenders
Patna High Court Cr.Misc. No.24822 of 2017 (2) dt.11-07-2017 before the court below within a period of three weeks, the court below will pass an order on the same day on its own merit without being prejudiced by the order passed by this Court.
