The petitioners seek bail in Amour P.S. case No. 166 of 2018 registered under Section 463, 467, 468, 474, 471, 420, 120B/34 of the Indian Penal Code.
The Circle Officer, Amour alleged that on secret information that Zamshed Alam is indulged in forging the documents and his father, Md. Hasibur Rahman and brother, Md. Parvej Alam, are also assisting him he raided the house and recovered huge quantity of forged documents of settlement of lands, disability certificated, seal of different officials and documents of different cases pending in the court of CJM and blank forms of death certificate.
The learned senior counsel for the petitioners submits
Patna High Court Cr.Misc. No.75240 of 2018(2) dt.17-12-2018 2/2 that Zamshed Alam is alleged to have indulged in forging the documents. The petitioners are father and brother of Zamshed Alam. There is no material to show that petitioners are indulged in preparing forged documents with Zamshed Alam. The petitioners are in jail since 04.09.2018.
Considering the facts aforesaid and nature of allegation made against the petitioners and the fact that petitioners are father and brother of Zamshed Alam and they have remained in jail for about three and half months, the petitioners, above named, are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the lime amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Amour P.S. case No. 166 of 2018.
