The petitioners seek bail in anticipation of their arrest in connection with Pear P.S. Case No. 159 of 2019, dated 11.08.2019, instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 325, 307, 376 and 511 of the Indian Penal Code.

Patna High Court CR. MISC. No.26484 of 2020(3) dt.08-12-2020 2/2 Regard being had to the nature of accusation against the petitioners, I am not inclined to grant anticipatory bail to them.

The prayer for grant of anticipatory bail of the petitioners is, accordingly, rejected.

However, if the petitioners surrender before the Court below and seek regular bail, the Court below shall consider the case on its own merits without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court and that against the petitioners, there is only allegation of assaulting the informant and his family members by lathi.

The application stands dismissed.
