JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 01-07-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under Section 420 of the Indian Penal Code.
It is alleged by the complainant that the accused Bachchi Lal Yadav had sold land to her which he had already registered in faovur of Naresh Yadav.
The petitioner submits that the main allegation is against accused Bachchi Lal Yadav.
The petitioner is correct to the extent that the main allegation is not against him but against accused Bachchi Lal Yadav.
Having considered the facts and circumstances of the case,
Patna High Court Cr.Misc. No.25565 of 2016 (2) dt.01-07-2016 the petitioner Naresh Yadav is directed to be released on anticipatory bail, in the event of his arrest/surrender, in connection with Complaint Case No.2867C of 2015, on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of Shri Kumar Amit Manu, Judicial Magistrate 1st Class, Araria. It is made clear that the trial court, in seisin of the case, would dispose of the case within 1 1⁄2 years from the date of the order and would not grant unnecessary adjournments to the accused.
