The petitioner is in custody in connection with Buxar (T) P.S. Case No. 123 of 2019 for the offence under Section 30 (a) of the Bihar Prohibition and Excise Act 2016. Learned counsel appearing on behalf of the petitioner submits that in the instant case total 23.40 liters was seized. Learned counsel for the petitioner submits that liquor was seized from the joint house and not from the exclusive possession of the petitioner. Learned counsel for the petitioner submits that petitioner is in custody since 16.02.2019.

Considering the fact that liquor was seized from the joint house not from the exclusive possession of the petitioner, the Court is inclined to grant bail to the petitioner. Let, the
