Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioner seeks bail in connection with Kotwali P.S. Case No. 221 of 2022 registered for the offence under Sections 323, 341, 307, 504/34 of the Indian Penal Code. The prosecution story in short is that on 20.05.2022 at abut 02.00PM, the brother of the informant was going to school. In the way petitioner met the brother of the informant at some distance of his house. Brother of the informant demanded arrears amount from the petitioner upon which petitioner started
Patna High Court CR. MISC. No.23993 of 2023(2) dt.18-05-2023 2/3 abusing and told him that he will not pay the arrears amount. Again on the same day at about 03:00 PM, petitioner alongwith his father and brother armed with bat came to the house of informant and started abusing the informant. Thereafter, on the order of Ajay Yadav, Shivo Yadav caught the informant and the petitioner assaulted him on his head with bat due to which the informant sustained serious injury on left side of his head. The informant became unconscious and accused persons fled away from the house of informant. Family members of informant brought to the informant to Sadar Hospital, Munger for treatment.
Learned counsel for the petitioner submits that the petitioner is in custody since 14.12.2022 and there is no evidence against the petitioner and the petitioner is quite innocent and has been falsely implicated in this case. Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the period of custody, this application for regular bail is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the
