JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-07-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 341, 323, 504, 324, 307, 325, 379/34 of the Indian Penal Code.

On the alleged date and time of occurrence, this petitioner along with other co-accused is alleged to have assaulted the niece of the informant with lathi. It is submitted on behalf of the petitioner that the present case is the counter blast of Complaint Case No. 1725 of 2022 filed by aunt of the petitioner against the informant members for the same occurrence of 15.08.2022 at 8 PM. Moreover, the present FIR has been filed on 17.08.2022 after delay of two days, which in itself, raises serious doubt over the

Learned counsel for the State opposes the pre-arrest bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj in connection with Baikunthpur P.S.
