The petitioner seeks bail in Katoriya (Suiya) P.S. Case No. 49 of 2012, instituted for the offence under Section(s) 147, 148, 149, 341, 435 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of C.L.A. Act. Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. The name of petitioner has come in the confessional statement of co-accused Rakesh Das @ Dilip Das who has already been granted bail by the court below on 26.7.2013 in B.P. No. 313.

Petitioner is in custody since 5.2.2019 having clean

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Katoriya (Suiya) P.S.
