24.08.2020 Heard Mr. Sanjeev Kumar Singh, learned counsel for the petitioner and Mr. Uday Pratap Singh, learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Katihar Town P. S. Case No. 117 of 2020 dated 09.02.2020, instituted for the offences under Sections 304 and 34 of the Indian Penal Code.

The husband of the informant is said to have been

electrocuted. The deceased was a Lineman who had climbed the pole to repair the electricity line and while he was at his work, the electricity line was restored leading to his electrocution. The petitioner is another Lineman. It has been submitted on behalf of the petitioner that the F.I.R. has been lodged after five days of the occurrence. It has further been submitted that the case has only been lodged against the petitioner and others so as to take advantage of the death of the deceased by his family members.

Some of the other accused persons of this case have been granted anticipatory bail.

Regard being had to the nature of accusation against the petitioner, he, above-named, in the event of his arrest or surrender before the court below within a period of eight weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial

Magistrate, Katihar in connection with Katihar Town P. S. Case No. 117 of 2020 , subject to the conditions laid down under Section 438(2) of the Cr.P.C.
