The petitioners apprehend their arrest in Barun P.S. case No. 45 of 2019 registered under Section 379, 411, 420/34 of the IPC and u/s 4 and 40 of Bihar Minor Mineral Concession Rule and Section 15 of Environment Protection Act. The informant intercepted many tractors loaded with Sone sand.
The learned counsel for the petitioners submits that petitioners are owner and driver of the tractor. The driver of the tractor was carrying sand on valid permit.
Considering the facts aforesaid and nature of allegation made against the petitioners, the petitioners, above
Patna High Court CR. MISC. No.22638 of 2019(2) dt.11-04-2019 2/2 named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. case No. 45 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
