Mr.Surendra Prasad Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 20-05-2024 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. The petitioners are apprehending their arrest in a case in connection with Sasaram (M) P.S. Case No. 583 of 2023 dated 31.10.2023 registered for the offence/s punishable u/ss 147, 148, 149, 341, 323, 324, 307, 379, 504, 506 of the Indian Penal Code.

3. As per the prosecution case, when the informant was constructing ladder in front of his house, in the meantime,

Thereafter, one Ravi Ranjan Paswan assaulted the informant with knife on his neck due to that he fell down and became unconscious. It is further alleged that the they also snatched golden chain and ear top from his wife.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. There is general and omnibus allegation against the petitioners. The specific allegation of assault is against the co-accused Ravi Ranjan Paswan. The injury of the informant is stated be simple in nature. The petitioner no 1 has 2, the petitioner no. 2 has one, the petitioner no. 3 has 1 criminal antecedent and the petitioner nos. 4 and 5 have no criminal antecedent as stated at para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

6. Considering the aforesaid facts and circumstances of the case as well as the allegation being general and omnibus, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) each with two sureties of the like amount

Patna High Court CR. MISC. No.30265 of 2024(2) dt.20-05-2024 3/3 each to the satisfaction of learned court concerned, Rohtas at Sasaram in connection with Sasaram (M) P.S. Case No. 583 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
