At the outset, it is submitted that during pendency of this application, petitioner No. 2 namely, Mulendra Ram has been taken into custody and hence, the application in respect of petitioner No. 2 is dismissed as withdrawn.

The rest petitioners are apprehending their arrest in a case registered under Section 366(A) of the Indian Penal Code. The prosecution case, in brief, is that the accused persons seduced the informant's daughter and kidnapped her and when

Patna High Court Cr.Misc. No.79520 of 2018(2) dt.01-02-2019 2/3 the informant enquired, then the accused persons threatened to kill the victim girl.

It has been submitted on behalf of the petitioner Nos. 1, 3, 4 & 5 that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been falsely implicated in the present case. The victim has been recovered and examined u/S 164 of the Cr.P.C. in which, she has not supported the allegations, made in the FIR. As per her statement, she had left her house out of her own sweet will and has performed marriage with one Gajendra Kumar. Petitioners are said to be relatives of said Gajendra Kumar.

On behalf of the State, it is submitted that the petitioner Nos. 1, 3, 4 & 5 are named in the Complaint Case/F.I.R. Considering the aforesaid facts and circumstances, let the petitioner Nos. 1, 3, 4 & 5, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Danapur in connection with Rani Talab P.S. Case No. 295 of 2018, subject to the conditions
