JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 12-08-2015 The present modification has been filed for recalling of the order dated 09.01.2014 passed in Cr. Misc. No. 52168 of 2013, whereby Cr. Misc. No. 52168 of 2013 was permitted to be withdrawn on the prayer made by the learned counsel for the petitioners.

Cr. Misc. No. 52168 of 2013 was filed by the petitioners Keyur Majumdar and Supriti Bandopadhyay for setting aside the order dated 02.11.2013 passed in Cr. Revision No. 114 of 2012/ Tr. No. 03 of 2013 by learned Ad hoc Additional Sessions Judge, IVth, Patna affirming the order dated 21.01.2012 passed in Complaint Case No. 3251(C) of 2009, whereby the

Patna High Court Cr.Misc. No.32569 of 2014 (02) dt.12-08-2015 2/2 application of the petitioners dated 11.07.2011 under Section 205 Cr.P.C. was rejected.

The petitioner in the present modification application Kanishk Sinha claims that the signature of the above petitioners of Cr. Misc. No. 52168 of 2013 on the Vakalatnama was forged.

The present modification application has been filed in person by Kanishk Sinha. Now Mr. Gopal Sharan, an Advocate of Patna Civil Court, is appearing on behalf of petitioner Kanishk Sinha, but no Vakalatnama is on record. Counsel appearing on behalf of Registrar, Civil Court, Patna submits that several such frivolous applications have been filed.

Considering the fact that petitioners of Cr.

Misc. No. 52168 of 2013 have not come forward to say that the Vakalatnama is forged, this Court is not inclined to interfere. Hence, the present modification application is dismissed.
